Please read these Terms and Conditions ("Terms") carefully before using the AskSary website and applications (the "Service") operated by Sary Ismail ("us", "we", or "our"), based in the Kingdom of Bahrain. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.
Your continued use of the Service constitutes acceptance of these Terms and any updates we publish. We will notify you of material changes by updating the "Last updated" date above. Your access is also conditioned on your acceptance of our Privacy Policy.
Minimum Age: You must be at least 13 years old to create an account or use the Service.
Parental Permission: If you are between 13 and 18, you represent that your parent or legal guardian has given permission and agreed to these Terms on your behalf.
Account Responsibility: You must provide accurate, complete, and current information. You are solely responsible for maintaining the security of your credentials and for all activity under your account.
Age of Purchase: You must be at least 18 years old to purchase a Premium or Ultra subscription.
Billing: Paid plans are billed on a recurring basis. Payments are processed securely by Stripe.
Auto-Renewal: Your subscription renews automatically unless cancelled via Profile settings before the end of the current billing period.
Cancellations & Refunds: You may cancel at any time; cancellation takes effect at period end. All payments are non-refundable except where required by applicable law.
Your Content: You retain ownership of the prompts, files, and data you submit. You grant us a limited, non-exclusive licence to process this content solely to provide and improve the Service.
AI-Generated Content: To the extent permitted by applicable law, you own the output generated in response to your prompts. AI output is not guaranteed to be unique and similar responses may be generated for other users.
Content Standards: You are responsible for ensuring that any content you submit complies with these Terms and all applicable laws.

To protect the Service and its users, we operate automated systems that monitor usage patterns and enforce these Terms. By using the Service you acknowledge and agree to the following:
Request Rate Monitoring: We track the frequency and timing of requests on a per-account basis using anonymised session data stored in our systems. Accounts exhibiting automated or scripted behaviour (for example, sending more than 100 requests per hour with sub-5-second intervals) may be automatically suspended.
IP Address Logging: We log IP addresses associated with your account activity for security, fraud prevention, and abuse detection purposes. IP addresses are personal data and are handled in accordance with our Privacy Policy.
Content Safety System: All image generation requests are screened by automated content safety systems. Requests that violate our content policies are blocked and recorded against your account, including the nature of the violation, your account email, and your IP address at the time.
Violation Strikes: A first content policy violation results in a formal warning. A second violation results in an automatic permanent account suspension. Violation records are retained for audit and legal compliance purposes.
Automated Suspensions: We reserve the right to suspend or terminate accounts automatically where our systems detect a clear breach of these Terms. Automated suspensions are not a substitute for human review and may be appealed as described below.
Zero Tolerance — Child Exploitation: Any attempt to generate, request, or solicit content that sexually exploits or depicts minors will result in an immediate permanent account suspension with no warning and no right of appeal. All such attempts are logged in full, including the user's account details, IP address, and the content of the request. We reserve the right to, and may be legally obligated to, report such attempts to relevant authorities including but not limited to the Internet Watch Foundation (IWF), the National Center for Missing & Exploited Children (NCMEC) CyberTipline, and local law enforcement.
Termination by Us: We may suspend or terminate your account immediately, with or without notice, if you breach these Terms. For serious violations (including illegal content attempts), suspension may be permanent and automated.
Termination by You: You may delete your account at any time via Profile settings.
Effect of Termination: Upon termination, your right to use the Service ceases immediately. Unused subscription credits are non-refundable except where required by law.
Appeals: If you believe your account was suspended in error, you may submit an appeal directly from the suspension notice within the Service. An appeal will include the message context that triggered the suspension and will be reviewed manually by our team. We aim to respond within 5 business days. Submitting a false or misleading appeal may result in permanent suspension without further review.
As Is: The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or fit for any particular purpose.
No Professional Advice: Nothing in the Service or its AI output constitutes medical, legal, financial, or other professional advice. You should seek independent professional advice before acting on any AI-generated content.
Limitation of Liability: To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
AskSary is operated by Sary Ismail, based in the Kingdom of Bahrain. Our data infrastructure — including user data, account information, and AI conversation data — is stored and processed on servers located in London, United Kingdom. As a result, UK GDPR and the UK Data Protection Act 2018 apply to the processing of personal data of all users.
We also comply with Bahrain's Personal Data Protection Law (PDPL) and, where applicable, the EU GDPR for users located in the European Economic Area.
For security and abuse prevention purposes, we process IP addresses, usage metadata, violation records, and account identifiers. This processing is carried out on the basis of our legitimate interests in protecting the Service and its users from abuse, fraud, and illegal activity. Because our data infrastructure is located in the United Kingdom, these Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved amicably by contacting us at team@asksary.com. Where users are located in jurisdictions with mandatory consumer protection laws that provide greater rights (including EU member states), those rights are not limited by this clause.
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
